Terms of Service

1. Who this agreement is between

This agreement is between you and Calvera Labs ("Pupkin", "we", "us"). It applies when you create a Pupkin account, use the Pupkin apps, or use pupkin.app.

If you do not agree with it, do not create an account. If you have already created one and no longer agree, you can close it. See section 10.

2. Who may use Pupkin

You must be at least 18 and the parent or legal guardian of every child you set up in Pupkin. The account is yours, not your child's.

Pupkin is built for children aged 6 to 8, used under your supervision. There is no child login: your child uses Pupkin inside a profile you create and control. You are responsible for what happens under your account, including your child's use of it.

3. Your account and your household

You sign in with an email address and password, or with a Google account. Keep your sign-in details to yourself; tell us promptly if you think someone else has them.

A Pupkin household can have a second guardian, whom you invite. Both guardians have equal access to the children's profiles and their practice history. Only the guardian who created the household can manage the subscription or delete a child profile. Invite someone only if you are content for them to see everything about your children in Pupkin.

Give us accurate information, and keep your email address current, because it is how we reach you about consent, billing and anything that goes wrong.

4. Your child's use of Pupkin, and your consent

Before you can create a child profile, we ask for your verifiable consent to collect the limited information Pupkin holds about a child. What that information is, and what it is used for, is set out in the Privacy Policy, which forms part of this agreement.

You can withdraw that consent at any time. Doing so means we delete the child profile and the practice records under it, because we are not permitted to keep them without your consent.

5. Pupkin Plus

Pupkin is free to use with one child profile. The weekly summary email is included at no cost and is not part of the subscription.

Pupkin Plus is a paid subscription that raises the limit to four child profiles. It is offered as a monthly or an annual plan.

Free trial

New subscribers are offered a 7-day free trial, once. If you have used the trial before, you will be offered the plan without it. We will not describe something as a free trial when it is not. Unless you cancel before the trial ends, it becomes a paid subscription automatically.

Price, billing and renewal

The price is the one shown to you in the App Store or Google Play at the moment of purchase, in your local currency, including any tax those stores apply. We do not publish a price on this site because the stores set the local figure.

Subscriptions renew automatically at the end of each period, and the store charges the payment method on your store account, until you cancel. Apple and Google take the payment; we never see your card details. If a price changes, the store will tell you and ask for your agreement before charging the new amount.

Cancelling

You cancel in the App Store or Google Play, wherever you manage your other subscriptions. Not by emailing us, and there is no retention flow to sit through. Pupkin has a link that takes you straight to the right screen.

Cancelling stops the next renewal. It does not end the period you have already paid for: you keep Plus until that period runs out. If you cancel during a free trial you keep Plus until the trial's original end date.

If a subscription lapses

Nothing is deleted when Plus ends. Profiles beyond the first stay in your account and stay visible to you; you cannot add new ones until you are within the free limit or subscribe again. Your children's history is not held hostage.

Refunds

Refunds are handled by Apple or Google under their own policies, because they took the payment. We cannot issue a refund for a store purchase ourselves. If you think you have been charged unfairly, email us anyway. We will help you make the case to the store, and we would rather know.

6. What Pupkin is, and what it does not promise

Pupkin is practice, designed to make a daily habit appealing to a young child. It is not a curriculum, not a tutor, not an assessment, and not a diagnostic tool.

We do not promise a particular educational result. We will not tell you Pupkin will raise your child's grades, and you should be suspicious of any app that does. What we do promise is that the figures we report to you are real: every number in your weekly email is computed on our servers from work your child actually completed, and cannot be inflated by the app.

Pupkin is not a medical, psychological, or special-educational-needs service, and nothing in it is advice about your child's development.

7. Using Pupkin fairly

Please do not:

• Try to reach another household's data, or any part of the service you are not entitled to.
• Interfere with the service, or attempt to alter the progress figures our servers compute.
• Reverse engineer, copy, resell, or rent Pupkin, except where the law says you may.
• Use Pupkin to store or send anything unlawful, or put anything into a child's name or a puppy's name that you would not want a child to read.
• Create an account on behalf of a child who is not in your care.

If you are a security researcher, section 12 is not intended to stop you telling us about a vulnerability. Email us.

8. Content and ownership

Pupkin, including its software, puzzles, illustrations, and name, belongs to us or our licensors. You get a personal, non-transferable, revocable licence to use it for your household, for as long as this agreement lasts. Nothing here transfers ownership of anything to you.

What you put in, such as a child's name, a puppy's name and your settings, stays yours. You give us only the permission we need to run the service for you, as described in thePrivacy Policy.

9. Changes to Pupkin

Pupkin will change: activity types will be added, puzzles adjusted, and features improved or removed. If we remove something you are paying for, or make a change that materially reduces what Plus gives you, we will tell you in advance and you may cancel.

We may suspend the service for maintenance, and it may occasionally be unavailable for reasons outside our control. We do not promise uninterrupted availability.

10. Ending this agreement

You can stop using Pupkin whenever you like, and you can close your account from within the app or by emailing support@pupkin.app. Closing your account deletes your household and your children's data. Cancel the subscription in the store as well, because closing a Pupkin account does not cancel a store subscription and we cannot cancel it for you.

We may suspend or close an account that is being used in breach of section 7, or where we are required to by law. Except where the breach makes it impossible, we will tell you why and give you a chance to put it right. If we close your account without cause, we will refund the unused part of any period you have paid for.

11. Disclaimers

Pupkin is provided as it is. Beyond what this agreement says and what the law requires of us, we do not make guarantees about the service: that it will be uninterrupted, error-free, or fit for any particular purpose you have in mind.

Some consumer protection laws give you rights that cannot be excluded. Nothing here removes them. If you are a consumer, this section applies only to the extent the law where you live allows.

12. Limitation of liability

We are not liable for indirect or consequential loss, or for lost data where you could reasonably have kept your own copy. Where we are liable, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or [FLOOR AMOUNT].

We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. If you are a consumer, your non-excludable rights come first.

13. Indemnity

If someone brings a claim against us because of how you used Pupkin in breach of these terms, you agree to cover the reasonable costs of dealing with it. This does not apply to anything that is our fault.

14. Governing law and disputes

This agreement is governed by the law of [JURISDICTION], and disputes go to the courts of [JURISDICTION]. If you are a consumer living elsewhere, you keep the right to bring a claim in your own country where local law gives it to you.

Before anything formal, please email us. Most things are a misunderstanding we can fix in a day.

15. Changes to these terms

We will update the date at the top when these terms change, and tell you in the app before a change that affects your rights or what you pay takes effect. If you do not accept a change, you can cancel and close your account. Continuing to use Pupkin after a change takes effect means you accept it.
